Plaintiff in error, Reuben M. Ellerd, brought this suit against L. A..'White and others.to set aside a certain judgment of the district court of Hale county, in cause No. 1816, to cancel certain deeds made in pursuance to such judgment, to recover various tracts of land, some of which were conveyed by deeds executed under the judgment, and' some not, to cancel certain notes, etc., and to recover $77,300 actual and $100,-000 exemplary damages on account of fraud alleged to have been perpetrated by the defendants in connection with the handling of said properties and other transactions…
