This local property tax matter is presently before the court on defendant’s motion to vacate the judgment previously entered and to dismiss the complaint.

The facts are not in dispute. The subject property is known as Block 153, Lot 37. For the tax year 1986 the assessment was:

Land $206,300

Improvements 13,000

Total $219,300.

The property owner was dissatisfied with the assessment and filed a petition of appeal with the Atlantic County Board of Taxation, which entered a judgment confirming the assessment. Thereafter, on March 6, 1987, taxpayer filed a complaint with the Tax Court…
