MYERS, District Judge.

This proceeding, instituted in the court of common pleas for Charleston county and now in this court under proceedings in conformity with the removal statute, was brought by the plaintiff in her capacity as administratrix under the South Carolina statute seeking damages for wrongful death of her intestate through alleged negligence and misconduct on the part of the defendant Armour & Company.
