An equitable petition was filed to restrain the execution of a warrant to dispossess the plaintiff as a tenant holding over, alleging that the deed which he had executed to the defendant was infected with usury, and that the defendant was to make or procure a loan for him. He prayed for injunction, accounting, specific performance, and general relief. The defendant denied that there was usury in the consideration of the deed; denied the agreement alleged in the petition; and averred that he purchased the land from the plaintiff, who rented it from him, that the plaintiff was insolvent, and…
