On January 2, 1937, the appellee filed in the Clark circuit court a complaint against the appellants for damages for personal injury and death of Holman Hampton, alleged to haye been caused by the negligence of appellants. The appellee- alleged that on August 4, 1936, on account of the joint and concurrent negligence of all the defendants, the said Holman Hampton was seriously and fatally injured, and from the effects of said injury he died in the Missouri Pacific Hospital in Little Rock, Arkansas, on August 29; 1936.
