I. INTRODUCTION
On September 17, 2013, Plaintiff Alley Sports Bar, LLC (“Plaintiff’) filed a complaint against Defendant SimplexGrinnell, LP (“Defendant”) in the Supreme Court of Wayne County, New York, alleging the following claims: (1) negligence; (2) gross negligence; (3) breach of fiduciary duty; (4) negligent misrepresentation; and (5) punitive damages.
