TURK, Chief Judge.

Plaintiff, who is employed by the United States Postal Service (“Postal Service”) in Lynchburg, Virginia, instituted this action against the American Postal Workers Union, AFL-CIO (“APWU”) and its vice president, alleging that the APWU breached its duty to fairly represent plaintiff in connection with the latter’s grievance against the Postal Service. The action arises under 29 U.S.C. §§ 159(a) and 185. Jurisdiction is asserted under 29 U.S.C. § 185.
