RODGERS, Justice:

This is a suit begun in the Chancery Court of Humphreys County, Mississippi, to terminate a partnership of the heirs at law of O. J. Turner, deceased, in estate property.

The amended bill alleges that the defendant members of the partnership acted in a fiduciary capacity for their younger brother, Joe Ware Turner, the husband of Mrs. Maurine L. Barrett and the father of the other complainants. The bill alleges that the defendants did not deal fairly with the deceased, Joe Ware Turner.
