This matter, which is now before the Court, involves the consideration of the interplay between the interests of the State of Utah (“Utah”) in protecting its environment and populace, and the public policy expressed by Congress in the enactment of the Bankruptcy Code which enables debtors to seek a fresh start by filing a petition in this Court.
