This is a suit in assumpsit by which plaintiff seeks recovery from defendant of $427,000 and accrued interest. In a non-jury trial defendant had judgment and plaintiff has appealed. In 1926 plaintiff was the president and director, also a member of the executive committee and of the financial committee, of the Electric Refrigeration Corporation, a holding company having as subsidiaries and holding all the stock of the Nizer Corporation, the Leonard Refrigerator Company, and Kelvinator Company.
