In my judgment the majority opinion affirming the judgment of conviction contravenes certain fundamental principles and consti-. tutional' guaranties 'of personal liberty as set forth in the “Bill of Rights” of both the Constitution of the United States and the Constitution of the State of Oklahoma, in the procedure through which it was obtained, as hereinafter stated in my opinion, and also contravenes what has been the well settled law of this jurisdiction.
