This case involves a contest over the ownership and diyision of the estate of Adolph Weber, Jr., deceased. The complainant was born in Leipsic, in the kingdom of Saxony, on the 9th day of September, 1860. Between the latter date and the year 1865 or 1866 his father, after cruelly treating Ms mother, Wilhelmina Ehrlich, deserted her and abandoned his family. Regardless of whether the said Wilhelmina and her husband Adolph Weher, Sr., were aliens, their children, Emma, and Adolph, Jr., having been born in this country and under its jurisdiction, became at once, by virtue of such birth, American citizens.
