When I prepared my original dissenting opinion in this case we were in the closing hours of the last term of this court, the opinion being delivered on the day of adjournment. My treatment of the question then was necessarily hurried, and to some extent imperfect. Since then, and particularly during the summer vacation I gave the question careful consideration and investigation, such as was not possible when the question was before us in term time.
