The plaintiff is a collective bargaining unit representing correction officers employed by the Sheriffs Department of the County of Nassau. Pursuant to section 23.1 of the collective bargaining agreement (hereinafter CBA) between the plaintiff and the County, “[a] County employee, at least one-half of whose shift is between 4:00 p.m. and 8:00 a.m. shall receive additional shift differential for each hour actually worked, regardless of whether such hours are between 4:00 p.m. and 8:00 a.m.” The plaintiff commenced this action against the County, alleging that the County was in breach of…
