HAWKINS, Judge.
Appellant was convicted for murder without malice aforethought and his punishment assessed at three years in the penitentiary. The name of deceased was Will Sisk.
One contention made by appellant is that he should have been granted a new trial on the ground of newly discovered evidence. In order to discuss the matter understanding we set out the facts with more particularity than is usually thought necessary.
