This is an appeal from a judgment of the district court of Grayson county, entered upon the verdict of a jury awarding appellee $15,000 damages for the death of her husband, Joseph W. Fesmire, while in the discharge of his duties as an em-ployé of appellant. Fesmire, at the time he lost his life, was head brakeman upon a water train. This train loaded with water at Honey Springs in Dallas county, Tex., and was hauled to and unloaded at a tank on appellant’s line of railway in Rockwall county, Tex.; the water being subsequently pumped into the tank.
