It appears that on May 24, 1948, plaintiff and defendants, the latter of whom are husband and wife, enter' ed into an agreement in writing whereby the defendants under' took to sell and convey to plaintiff a certain piece of land with a oneffamily dwelling thereon designated as No. 52 East Laugh' lin Road in Stratford, in this state, for the sum of $11,250 subject to a mortgage in the amount of $5500, upon which price a recited deposit of $500 paid by plaintiff applied.
