MEMORANDUM OF OPINION

PAUL MANNES, Bankruptcy Judge.

This matter is before the court upon the defendant’s motion to dismiss the complaint. Defendant urges that the judgment entered in a prior action involving Regal’s surety and defendant precludes the relitigation of Regal’s claim here. The court finds this reasoning persuasive. Treating the instant motion as one for summary judgment, and finding no genuine issue of material fact, the court will set for its findings and conclusions and file its proposed judgment in favor of defendant.
