GILBERT, Circuit Judge.

This'is an appeal from a judgment denying a petition for a writ of habeas corpus. The appellant, who was born in China, claimed the right to enter the United States as the son of Wong Toon Yow, an American citizen. In order to prove that he was the son of his alleged father, it was necessary to ghow that he was born, as he claimed to have been, 13 years and 9> months prior to the time of the hearing before the board of inquiry.
