Appeal from Circuit Court, Minnehaha County. Hon. Joseph W. Jones, Judge. Action by W. A. Greenwald against G. A. Ford and another. From a judgment for plaintiff, defendant Ford appeals. Affirmed.

This action, against G. A. Ford and the State' Banking & Trust Company of Sioux Falls, was to recover $475 alleged to' have been paid to them August 15, 1904, by plaintiff’s assignor, the Farmers’ State Bank of Preston, Neb., on a forged check purporting to have been drawn in favor of L. C. Gibson, or bearer, by E. Hoselton, whose checks the bank had full authority to pay and charge to the account of his employer, W. A. Margrave.
