In a proceeding pursuant to CPLR article 78, inter alia, to compel respondent to restore petitioner to the position of principal psychologist, from which position petitioner had been "demoted”, the appeal, as limited by petitioner’s brief, is from so much of an order of the Supreme Court, Dutchess County, dated December 27, 1976, as, upon reargument, dismissed the petition on the merits. Order affirmed insofar as appealed from, without costs or disbursements. Petitioner was permanently appointed to the position of associate psychologist (grade 23) in March, 1970.
