This CPLR article 78 proceeding presents a challenge to a determination by the Fire Commissioner of the City of New York finding petitioner guilty of insubordination to a superior officer.
Petitioner, an acting lieutenant at the time of the incidents which are the subject of this proceeding, joined the fire department in 1963 and has spent the bulk of his career in the community relations bureau, although he has had intermittent service in firefighting units.
