DAUES. J.

This is an action for malicious prosecution; the petition prays for the recovery of actual damages in the sum of $25,000, and punitive or exemplary damages in the sum of $25,000. The answer is a general denial. The trial before the court and a jury resulted in a verdict and judgment for plaintiff in the sum of $1,000 as actual damages, and $500 as punitive damages, from which defendant appeals.

About February 2, 1917, plaintiff purchased a Ford automobile from the Krause Motor Corporation at Webster Groves, Missouri. This ear is identified by its factory number, to-wit No. 1559447.…
