This action is brought to remove an alleged cloud upon the title to plaintiff’s real property. The facts are stipulated, and the defendants move for a dismissal of the complaint upon the several grounds hereafter considered.

It appears that in the year 1877, one James Barnes was residing on block 26, lots 1 and 2, corner of Lock and Main streets, in the village of Phoenix, Oswego county, N. Y., and that he was in possession and held the same as trustee for his children. The exact nature of the trust does not appear.
