The defendant DiFuria was the owner and is in possession of the premises described in the complaint. The plaintiff is the holder of a tax deed of the same premises executed and delivered to her on December 9,1911, by the county treasurer of Onondaga county. This deed was recorded on the same day.

The case was tried at the Onondaga Trial Term on October 23,1913. The tax deed referred to was offered and received in evidence over the objection of the defendants.
