Joseph L. Witherspoon (defendant) was charged with rape, deviate sexual assault and three counts of aggravated kidnapping. The State dismissed the deviate sexual assault and aggravated kidnapping with intent to commit deviate sexual assault charges and proceeded to trial on the remaining counts.
