The following is a statement of this case as made .by the Court of Civil Appeals of the Fifth Supreme Judicial District:

“Mrs. Boesch and companions were riding in a buggy on a street in the town of Whitney and when they approached within thirty or forty feet of the point where the railroad track crosses said street they saw a train approaching and stopped their horse for the train to pass. It is alleged that when the train reached the crossing the engineer negligently caused steam to escape from the engine, causing a loud and unusual noise, which frightened the horse and caused it to run…
