This was a criminal prosecution wherein the defendant was convicted of embezzlement. He appeals.
Defendant was clerk of the district court for several terms. He retired from that office in January, 1932. At that time his books were audited. He lacked about $10,000 of having money enough to pay the amount that was charged to him as clerk. A more detailed examination was then had.
