OPINION AND ORDER

CARL B. RUBIN, Chief Judge.

This case is before the Court on Defendant’s Motion to Dismiss Plaintiff’s Amended Complaint. Plaintiff has filed a memorandum in opposition and a motion for summary judgment with supporting memorandum.

PROCEDURAL HISTORY

Plaintiff filed at least four applications with the Social Security Administration (hereinafter SSA) seeking disability benefits. (Tr. 17) The first application was filed in 1964.
