Affirming.

Lee Vanover and Chester .Shell were indicted by the grand jury of Harlan connty charged with the murder of Mart Pace. In 1932, Vanover, on a separate trial, was convicted by a jury, and his punishment fixed at imprisonment for life. He prosecuted an appeal to this court, insisting that certain admitted evidence was incompetent; the verdict was flagrantly against the evidence, and the instruction authorizing his conviction as an aider and abettor was defective and improper.
