—In an action to recover damages, inter alia, for breach of contract, violation of General Business Law § 349, fraud, and civil racketeering, the defendants appeal, as limited by their brief, from so much of an order of the Supreme Court, Kings County (Williams, J.), dated June 4, 1991, as denied those branches of their cross motion which were to dismiss the second and fourth causes of action asserted in the complaint.

*359Ordered that the order is reversed insofar as appealed from, with costs, those branches of the defendants’ motion which were to dismiss the second and fourth causes of action…
