In an action to foreclose a mortgage, the defendants/third-party plaintiffs appeal from so much of an order of the Supreme Court, Putnam County (O’Rourke, J.), dated May 15, 2009, as denied their cross motion for summary judgment dismissing the complaint, for summary judgment on the issue of liability on their counterclaims for relief pursuant to the Federal Truth-in-*753Lending Act (15 USC § 1601 et seq.), and for summary judgment on the issue of liability on the fifth cause of action asserted in the third-party complaint.
Ordered that the order is affirmed insofar as appealed from, with costs.
