ERROR to the District Court, Carbon County, Hon. Dayid H. Craig, Judge. The plaintiff in error, Robert Casteel, was charged with murder in the second degree for the killing of one Mels Thorn. He was convicted of manslaughter. The defendant, on his trial, offered to prove uncommunicated threats of the deceased against him, but the court refused to admit the testimony. Upon a trial before a jury in the district court the plaintiff in error was found guilty of the crime of manslaughter, the verdict being returned upon the 26th day of May, 1899.
