This is an action to recover from the owner of lots fronting on a small street in San Francisco, called Perry street, the portion of the cost of improving the street assessed on said lots. The contract and proceedings were all regular, and sufficient to constitute a cause of action, provided the Board of Supervisors had jurisdiction over the street, to authorize the improvement to be made, and their jurisdiction over the subject matter depends upon the question whether or not, at the time the work was authorized, Perry street was a public street.
