The Attorney General and Immigration and Naturalization Service (INS) appeal the district court’s summary judgment to a plaintiff class of alien minors whose named representative is Jenny Flores (Flores). The district court held that an INS regulation governing the release of detained alien minors violates substantive due process, and ordered modifications to the regulation.
