The parties will be referred to here as they were designated in the trial court. The plaintiff, Pearl Hicks, is a negress and freedman citizen of the Creek Nation, and as such was allotted 160 acres of land in McIntosh county. On the first day of August, 1912, she made a deed to all of said land to the defendant. Soon thereafter she instituted suit against defendant for the cancellation of said deed, alleging that said deed was obtained through fraud and deception.
