*406In an action to recover damages for personal injuries, the plaintiff appeals from an order and judgment (one paper) of the Supreme Court, Kings County (Levine, J.), entered May 28, 2003, which granted the defendant’s motion to dismiss the complaint on the ground of a defective notice of claim, and dismissed the complaint.
Ordered that the order and judgment is reversed, on the law, with costs, the motion is denied and the complaint is reinstated.
