Defendant, Samuel T. Miller, Jr., has filed preliminary objections to the amended complaint of plaintiff, John Koch, doing business as Central State Supply Company. Plaintiff is the operator of several downtown parking lots in the City of Harrisburg, Pa. On July 2, 1959, one of plaintiff’s customers, Samuel A. Burns 2nd, left his automobile in the custody of plaintiff. On that day, plaintiff ordered one of his employes to drive the car to another parking lot and, while so doing, the employe was involved in a collision with defendant’s car.
