The question at issue in this- case is as to the validity of an agreement to compromise a suit in the ■ *652chancery court of Shelby county brought by complainant to have the will of his wife, Mrs. Lena Dan-heiser, declared ineffective as to certain personalty belonging to her upon the ground that said personalty was her general estate, and as such belonged to complainant.
In the settlement of said suit the sum of $500 was left on deposit with defendant bank to effectuate the compromise.
