Petitioner-appellant, Cley Jackson, appeals from a judgment of the District Court denying his petition for habeas corpus. Cley Jackson was indicted in Shelby County, Tennessee in 1959 for the offense of rape and assault with intent to commit murder in the first degree. Approximately three weeks before his arraignment and plea of guilty, Jackson was appointed counsel. He received a five year sentence for the offense of assault to commit murder in the first degree, and life imprisonment for the offense of rape.
