The defendant has filed a motion pursuant to CPL 440.10 (1) *326(h) to vacate the judgment of conviction for attempted murder in the first degree (Penal Law § 125.27 [1] [a] [i]), rendered by a jury on June 2, 1988, on the ground that he was denied the constitutional right to the effective assistance of counsel at trial. (US Const 6th, 14th Amends; NY Const, art I, § 6.) The defendant was represented at trial by two people.
