The bill of complaint filed in this case asks that a certain deed to defendant of a described store property in the village of Mt. Morris, Genesee county, be declared a mortgage and plaintiff permitted to redeem.
For some time prior to and on June 2, 1908, defendant, Frances A. Cashin, and her brother, McArthur T. Cashin, owned as tenants in common the property in question which was left them by their father subject to a life estate.reserved to his wife and their mother, Mary A. Cashin.
