Appeal from a judg*963ment of the County Court of Albany County (Aison, J.), rendered June 29, 1989, upon a verdict convicting defendant of the crime of criminal possession of a controlled substance in the third degree.

Defendant was arrested after a 45-minute surveillance of him in his vehicle, which was parked on North Swan Street in the City of Albany. A search of his person resulted in the seizure of three packets of a white powdery substance later determined to be cocaine.
