This was replevin by the appellee against the appellant, for a quantity of unthreshed wheat, alleged to have been unlawfully detained.

Questions are presented upon instructions to the jury, given and refused by the court below. But the appellee contends that these questions are not in the record, for the reason that the bills of exceptions, by which the facts appear, were not filed in time.
