The People appeal from an order setting aside a three-count indictment charging defendants Backus, Joseph, and Ward in count I with conspiracy to pervert and obstruct justice and the due administration of the laws (Pen. Code, § 182, subd. 5), 1 defendants Joseph and Ward in count II, and all three defendants in count III, with conspiracy to furnish heroin (Pen. Code, § 182; Health & Saf.
