PEDEN, Justice.

The City of Houston appeals from a judgment rendered in favor of Dan M. Moody, Jere M. Locke, Howard Tellepsen, First City National Bank as trustee for Kathryn Locke and the John Locke Master Trust, and Lakewood Heights Corporations of Houston No. 1 and No. 2 for debts incurred by Harris County Water Control and Improvement District No. 73 before it was annexed by the City late in 1972. The trial court found that the District was legally and equitably bound to repay the indebtedness and that the City succeeded to this liability upon annexation. The City argues on appeal that…
