The prisoner was put upon his trial before the Criminal Court of Shelby county, at the July Special Term of said Court, 1870, upon his plea of not guilty to an indictment for 'grand larceny. He was found *233guilty, and bis term of confinement in the Penitentiary was fixed by the jury at the period of five years. His motions for a new trial and in arrest of judgment being overruled, judgment was pronounced according to the verdict, and the prisoner appealed in error.
