This suit is by the petitioner, A. B. Frank Company, a Texas corporation, against the Secretary of State, Attorney General and State Treasurer, each in his official capacity as a representative of the State of Texas, to recover franchise taxes, interest and penalties for the years 1934 to 1943 in the sum of $1,03Í.27, which were paid under protest by petitioner in accordance with the provisions or article 7057, V. A. C. S. The trial resulted in a judgment denying petitioner any recovery, which was affirmed by the court of civil appeals. 190 S. W. (2d) 739.
