ZAGER, Justice.

We are asked to determine whether the district court properly granted summary judgment on the plaintiffs petition for declaratory relief and properly, denied the defendant’s motion for summary judgment. Iowa Arboretum, Inc. (Arboretum) and Iowa 4-H Foundation (4-H Foundation) entered into an agreement to develop an arboretum on 300 acres of .land owned by the 4-H Foundation and located in Boone County, Iowa.
