— In this case a verdict for $567.50 was rendered by agreement, subject to a reserved question as to whether the plaintiff was entitled to recover. The following facts pleaded in the statement of claim must be taken as true: The Commonwealth entered into a contract with J. H. Bowman to install the heating and ventilation work in the North Office Building in Capitol Park, Harrisburg. Bowman and the defendant company delivered a bond in the sum of $34,500 “to be paid to the said Commonwealth of Pennsylvania or its assigns,” conditioned for the faithful performance of the work,…
